Adicionalmente, a CHUPA CHUPS não se responsabiliza por nenhum dano e/ou prejuízo relacionado com o software e/ou hardware do utilizador, que resulte do acesso e do uso da Página Web.

Política relativa a hiperligações

 

a) Hiperligações da Página Web

 

Todos os terceiros que pretendam incluir num sítio Web ("Sítio de Hiperligação") uma hiperligação para a Página Web têm de obter uma autorização prévia expressa por escrito junto da CHUPA CHUPS e cumprir a legislação vigente, não podendo, em nenhum caso, alojar conteúdos, próprios ou de terceiros, que: (i) sejam ilícitos, nocivos, violentos, racistas, caluniosos, etc.; e/ou (ii) não sejam apropriados ou pertinentes para a atividade da CHUPA CHUPS.

A hiperligação nunca significa que a CHUPA CHUPS aprove, promova, garanta, supervisione e/ou recomende o conteúdo e/ou os serviços do Sítio de Hiperligação, nem que seja responsável pelo conteúdo do mesmo.

Em caso de incumprimento de qualquer um dos termos supracitados, a CHUPA CHUPS procederá, imediatamente, à revogação da autorização concedida ao Sítio de Hiperligação, que deverá eliminar a hiperligação.

b) Hiperligações com outros sítios Web

 

Na Página Web, podem existir diferentes hiperligações que permitem ao utilizador aceder a outros sítios Web ("Sítios Hiperligados").

A existência de Sítios Hiperligados nunca implica a recomendação, promoção, identificação e/ou conformidade da CHUPA CHUPS em relação às manifestações, conteúdos e/ou serviços oferecidos através dos Sítios Hiperligados. Propriedade industrial e intelectual

 

Todos os direitos de propriedade intelectual sobre os desenhos, bases de dados, programas informáticos subjacentes (incluindo os códigos fonte), assim como os diferentes elementos que integram a Página Web (textos, gráficos, fotografias, vídeos, gravações de áudio, combinações de cores, etc.) ["Conteúdos"], assim como a sua estrutura, seleção e ordem, são propriedade do GRUPO PVM, CHUPA CHUPS ou dos seus licenciantes. Os símbolos distintivos incluídos na Página Web (marcas e nomes comerciais) também são propriedade do GRUPO PVM).

 

A utilização da Página Web por parte do utilizador não supõe a cessão de nenhum direito de propriedade intelectual e/ou industrial relativamente à Página Web e aos Conteúdos.

 

É expressamente proibido ao utilizador a reprodução, transformação, distribuição, comunicação pública, disponibilização, extração e/ou qualquer outra forma de difusão não autorizada expressamente da Página Web, dos Conteúdos e/ou dos símbolos distintivos do GRUPO PVM, CHUPA CHUPS e/ou dos seus licenciantes.

Nulidade

 

Se qualquer uma das cláusulas do Aviso Legal for declarada, total ou parcialmente, nula ou ineficaz, tal nulidade ou ineficácia afeta apenas a cláusula em questão ou a parte da mesma que a torne nula ou ineficaz; as mesmas permanecerão vigentes em tudo o resto, considerando-se não vigente tal cláusula ou a parte da mesma que seja afetada. Para esse efeito, o Aviso Legal só deixará de ter validade exclusivamente no que diz respeito à cláusula nula ou ineficaz, e nenhuma outra parte ou cláusula do mesmo será anulada, invalidada, prejudicada ou afetada por tal nulidade ou ineficácia, exceto se for essencial afetar integralmente o Aviso Legal.

 

Legislação e jurisdição aplicável
